NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 14, 2019 which reads as follows:
"G.R. No. 238524 (People of the Philippines v. Arnold Ordez y Del Valle). — After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its Decision as to warrant the exercise of the Court's appellate jurisdiction.
There is no cogent reason to disturb the findings of fact and the assessment of credibility of witnesses made by the trial court, especially as the same were affirmed by the CA. As correctly observed by the CA, every link in the chain of custody — from the purchase of the seized drug from Arnold Ordez y Del Valle to its marking in the precinct immediately after Ordez's arrest, to its inventory and taking of photographs in the presence of witnesses, and to its delivery to the Philippine National Police Crime Laboratory for examination — has been duly accounted for.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated August 8, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 07403 and AFFIRMS said Decision finding accused-appellant Arnold Ordez y Del Valle GUILTY beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165, otherwise known as The Comprehensive Dangerous Drugs Act of 2002, for which he is sentenced to suffer the penalty of life imprisonment and to pay a fine of P500,000.00, plus the cost of suit.
