NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated March 2, 2016, which reads as follows:
"G.R. No. 218257 (People of the Philippines vs. Roy Alfred Nadurata y Paredes). — The Court resolves to NOTE:
(1) the letter dated January 8, 2016 of P/S II Richard Schwarzkopf, Jr., Superintendent of the New Bilibid Prison, Muntinlupa City, confirming the confinement therein of accused-appellant since July 26, 2013;
(2) the Office of the Solicitor General's Manifestation (in Lieu of Supplemental Brief) dated January 27, 2016 stating that it would no longer file a supplemental brief, there being no significant transaction, occurrence or event that happened since the filing of its Appellee's Brief of May 13, 2014; and
(3) accused-appellant's Manifestation (in Lieu of Supplemental Brief) dated February 4, 2016 stating that he is adopting his Brief for accused-appellant of January 8, 2014 as his supplemental brief and praying that this manifestation be considered as full compliance with the Resolution dated November 9, 2015.
After an exhaustive review of the allegations, issues and arguments presented by the parties, the Court resolves to DISMISS the appeal for failure of the accused-appellant, Roy Alfred Nadurata y Paredes, to sufficiently prove that the Court of Appeals committed a reversible error in its disputed Decision 1 dated September 26, 2014 as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Decision dated September 26, 2014 of the Court of Appeals in CA-G.R. CR-HC No. 06223 is AFFIRMED." (Jardeleza, J., no part in view of his participation in the Office of the Solicitor General; Bersamin, J., designated Additional Member per Raffle dated February 1, 2016.) CAIHTE
