Please take notice that the Court, Second Division, issued a Resolution dated16 March 2015 which reads as follows: HTcADC
"G.R. No. 213226 — People of the Philippines v. Michael Molo.
The records of this case were elevated to this Court on July 15, 2014, pursuant to the Resolution of the Court of Appeals (CA), dated June 25, 2014, which gave due course to the notice of appeal filed by the accused-appellant, Michael Molo.
The Court NOTES the Letter, dated November 15, 2014, of the Bureau of Corrections, Muntinlupa City, informing the Court that the accused-appellant was received in the New Bilibid Prison on July 20, 2012; and the separate manifestations filed by the accused-appellant and Office of the Solicitor General, dated November 19, 2014 and December 10, 2014, respectively, stating that they would no longer file their respective supplemental briefs and that they were adopting all the defenses and arguments raised in their briefs filed before the CA.
After a review of the records, the Court DISMISSES the appeal of the accused-appellant for his failure to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals in its April 24, 2014 Decision in CA-G.R. CEB-CR-HC No. 01376, finding accused-appellant Michael Molo GUILTY beyond reasonable doubt of the crime of Murder, as defined and penalized under Article 248 of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua with accessory penalties provided by law and to pay the heirs of the victim the amount of One Hundred Nineteen Thousand Three Hundred Eighty-Six Pesos and Seventy-Five Centavos (P119,386.75) as actual damages; Seventy-Five Thousand Pesos (P75,000.00) as civil indemnity; Fifty Thousand Pesos (P50,000.00) as moral damages; and Thirty Thousand Pesos (P30,000.00) as exemplary damages.
