SECOND DIVISION
[G.R. No. 222329. June 29, 2016.]
PEOPLE OF THE PHILIPPINES, plaintiff-appellee,vs. JENNY MISA Y LOPEZ, accused-appellant.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 29 June 2016which reads as follows:
"G.R. No. 222329 — (People of the Philippines v. Jenny Misa y Lopez).
The records of this case were elevated to this Court on February 5, 2016, pursuant to the Resolution 1 of the Court of Appeals (CA), dated November 3, 2015, which gave due course to the notice of appeal filed by the accused-appellant, Jenny Misa y Lopez.
The Court then issued its Resolution, 2 dated March 7, 2016, which directed both parties to submit their supplemental briefs, if they so desired. On April 26, 2016, the Office of the Solicitor General, filed a manifestation and motion 3 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised. On June 13, 2016, the accused-appellant filed a manifestation in lieu of supplemental brief 4 averring that he would adopt his Appellant's Brief filed before the CA.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law of the Court of Appeals in its September 30, 2015 Decision in CA-G.R. CR-HC No. 01138-MIN, finding accused-appellant Jenny Misa y Lopez GUILTY beyond reasonable doubt of Violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment, and to pay a fine of One Million Pesos (P1,000,000.00).
SO ORDERED. (Del Castillo, J., on official leave)"
Very truly yours,
(SGD.) MA. LOURDES C. PERFECTODivision Clerk of Court
