NOTICE

Please take notice that the Court, Second Division, issued a Resolution dated07 March 2016 which reads as follows:
"G.R. No. 209153 — People of the Philippines, plaintiff-appellee, v. Petronilo Miculob, accused-appellant.
After a careful review of the records of this case, the Court finds the appeal to be lacking in merit. We therefore adopt the findings of the Regional Trial Court of Tagbilaran City, Bohol, Branch 1 as affirmed with modifications by the Court of Appeals. Appellant Petronilo Miculob was correctly found guilty beyond reasonable doubt of the crime of rape and accordingly sentenced to suffer the penalty of reclusion perpetua. The awards of civil indemnity in the amount of P75,000.00, moral damages in the amount of P75,000.00 and exemplary damages in the amount of P310,000.00 are proper, as well as the imposition of interest at the rate of 6% per annum on all damages awarded from the date of finality of this Resolution until fully paid.
WHEREFORE, we ADOPT the findings of the trial court as affirmed with modifications by the Court of Appeals. The assailed June 26, 2013 Decision of the Court of Appeals in CA-G.R. CR HC No. 00130 finding appellant Petronilo Miculob guilty beyond reasonable doubt of the crime of rape and sentencing him to suffer the penalty of reclusion perpetua and ordering him to pay "AAA" civil indemnity of P75,000.00, moral damages of P75,000.00, exemplary damages of P30,000.00 and interest at the rate of 6% per annum on all damages awarded from the date of finality of this Resolution until full payment is AFFIRMED.
