NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 27 January 2016 which reads as follows:
"G.R. No. 218916 — People of the Philippines v. Alan Mendoza y Adam a.k.a Allan Mendoza y Pascual
The records of this case were elevated to this Court on July 21, 2015, pursuant to the Court of Appeals (CA) Resolution, dated October 9, 2014, which gave due course to the notice of appeal filed by Alan Mendoza y Adam a.k.a Allan Mendoza y Pascual (accused-appellant).
In a Resolution, 1 dated August 17, 2015, the Court notified the parties that they could file their respective supplemental briefs, if they so desired, within thirty (30) days from notice.
In its Manifestation and Motion, 2 dated October 20, 2015, the Office of the Solicitor General manifested that it would no longer file a supplemental brief as its Appellee's Brief filed before the CA had adequately addressed the issues and arguments raised by accused-appellant. In his Manifestation in lieu of Supplemental Brief, 3 dated October 29, 2015, accused-appellant stated that he had no intention to file a supplemental brief as the relevant issues were already discussed in his Appellant's Brief.
After a perusal of the records of the case, the Court resolves to dismiss the case considering that the accused-appellant failed to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the August 27, 2014 Decision, of the Court of Appeals in CA-G.R. CR-HC No. 05690 finding accused Alan Mendoza y Adam a.k.a Allan Mendoza y Pascual guilty of the crime of Illegal Recruitment in a Large Scale under Section 6 and 7 (b) of Republic Act (R.A.) No. 8042, imposing a penalty of life imprisonment and a fine of P1,000,000.00; guilty of three (3) counts of estafa under Article 315 paragraph 2 (a) of the Revised Penal Code, sentencing him to suffer 10 years, 8 months and 1 day of Prison n Mayor, as minimum, to 14 years of Reclusion Temporal, as maximum and ordering him to pay private complainants P90,000.00, P89,000.00 and P90,000.00 as civil indemnity; and imposing an interest rate of six percent (6%) per annum on the damages awarded from the date of finality of judgment until fully paid, is AFFIRMED in toto.
