NOTICE

Please take notice that the Court, First Division, issued a Resolution datedNovember 12, 2014which reads as follows: IDSEAH
"G.R. No. 212523 (People of the Philippines v. Juanito B. Medice). — The accused-appellant's manifestation, in lieu of supplemental brief, that he is adopting the Appellant's Brief dated December 26, 2011 as his supplemental brief, the same having adequately discussed all the matters pertinent to his defense; and the Office of the Solicitor General's manifestation, in lieu of supplemental brief, that it is no longer filing a supplemental brief, there being no significant transaction, occurrence or event that had happened since the filing of its Appellee's Brief dated May 18, 2012 are both NOTED.
After a judicious perusal of the records, the Court resolves to DISMISS the appeal for failure to show that the Court of Appeals (CA) committed any reversible error in upholding the conviction of accused-appellant Juanito B. Medice for the crime of Robbery with Homicide under Article 294 (1) of the Revised Penal Code.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the August 16, 2013 Decision 1 of the CA in CA-G.R. CR HC No. 05045 and AFFIRMS said Decision finding accused-appellant Juanito B. Medice GUILTY beyond reasonable doubt of Robbery with Homicide, with MODIFICATION as to the eligibility for parole and awards of damages, sentencing him to suffer the penalty of reclusion perpetua, without eligibility for parole, and to pay the following amounts: (a) P75,000.00 as civil indemnity; (b) P75,000.00 as moral damages; (c) P25,000.00 as temperate damages to the heirs of Harvey Wayne Tan y Uy; (d) P10,000.00 as civil damages; (e) P10,000.00 as moral damages; and (f) P10,000.00 as temperate damages to Dennis Tan y Uy. In addition, legal interest at the rate of six percent (6%) per annum shall be imposed on all amounts awarded from the finality of this judgment until fully paid.
