NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated July 24, 2017, which reads as follows:
"G.R. No. 215754 (People of the Philippines, Plaintiff-Appellee, v. Edmar Marcelo y Salazar @ "Toto", Accused-Appellant). — For automatic review is the Decision 1 dated April 24, 2014 of the Court of Appeals (CA) in CA-G.R. CR-HC No. 05831, which affirmed the Decision 2 dated October 3, 2012 of the Regional Trial Court (RTC), Branch 84 of Batangas City in Criminal Case Nos. 16800 and 16801, finding the accused-appellant Edmar Marcelo y Salazar @ "Toto" guilty of violation of Sections 5 and 11, Article II of Republic Act No. 9165.
After a perusal of the records of the case, this Court resolves to DISMISS the appeal for failure of the accused-appellant to sufficiently show any reversible error in the assailed CA's Decision.
WHEREFORE, the instant appeal is DISMISSED. The Court of Appeals' Decision dated April 24, 2014 in CA-G.R. CR-HC No. 05831 which found accused-appellant Edmar Marcelo y Salazar GUILTY of violation of Sections 5 and 11, Article II of Republic Act No. 9165 is AFFIRMED in toto.
