NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated February 27, 2019 which reads as follows:
"G.R. No. 237425 — (People of the Philippines v. Alfredo Maraya)
Before the Court is a notice of appeal seeking to reverse and set aside the August 10, 2017 Decision 1 of the Court of Appeals (CA) in CA-G.R. CR-HC No. 02227, which found Alfredo Maraya (appellant) guilty beyond reasonable doubt of two (2) counts of rape. The CA sentenced appellant to suffer the penalty of reclusion perpetua for each count of rape pursuant to Articles 266-A and 266-B of the Revised Penal Code without eligibility for parole and ordered appellant to indemnify the private complainant the amount of P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages for each charge.
The CA affirmed with modification the February 11, 2016 Joint Judgment 2 of the Regional Trial Court of Abuyog, Leyte, Branch 10, in Criminal Case Nos. 3190 and 3191.
After a perusal of the records, the Court resolves to DISMISS the appeal for failure of appellant to sufficiently show that the CA committed any reversible error in the assailed decision as to warrant the exercise of the Court's appellate jurisdiction. The Court does not find any cogent reason to disrupt the findings of the CA.
WHEREFORE, the appeal is DISMISSED. The August 10, 2017 Decision of the Court of Appeals in CA-G.R. CR-HC No. 02227 is AFFIRMEDin toto.
