NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 02 March 2016 which reads as follows:
"G.R. No. 219854 (People of the Philippines v. Ronald Mallari y Bernabe)
The records of this case were elevated to this Court on September 10, 2015, pursuant to the Court of Appeals (CA) Resolution, dated October 23, 2014, which gave due course to the notice of appeal filed by accused-appellant Ronald Mallari y Bernabe (accused-appellant).
On October 12, 2015, the Court issued a Resolution 1 notifying the parties that they could file their respective supplemental briefs, if they so desired, within thirty (30) days from notice.
On December 15, 2015, the Office of the Solicitor General filed its Manifestation 2 stating that it would dispense with the filing of a supplemental brief considering that the issues were fully and exhaustively discussed in its Appellee's Brief before the CA. On December 21, 2015, accused-appellant filed a Manifestation (In Lieu of Supplemental Brief) 3 stating that he would not file a supplemental brief as he would just adopt his Accused-Appellant's Brief before the CA.
After a perusal of the records of the case, the Court finds that accused-appellant failed to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the appeal is DISMISSED. The August 29, 2014 Decision of the Court of Appeals in CA-G.R. CA-HC No. 05767, which affirmed the August 28, 2012 Decision of the Regional Trial Court, Branch 64, Tarlac City in Criminal Case Nos. 15279 and 15280 finding accused Ronald Mallari y Bernabe guilty beyond reasonable doubt for violation of Section 5, Article II of Republic Act No. 9165 and sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 is hereby AFFIRMED in toto.
