NOTICE

Please take notice that the Court, Second Division, issued a Resolution dated 15 July 2015 which reads as follows:
"G.R. No. 215791 (People of the Philippines v. Jubaynai Malaguit y Moreno)
The records of this case were elevated to this Court on January 12, 2015, pursuant to the Resolution of the Court of Appeals (CA), dated June 18, 2014, which gave due course to the notice of appeal filed by accused-appellant Jubaynai Malaguit y Moreno.
In compliance with the Court's Resolution, dated March 9, 2015, the Office of the Solicitor General and the accused-appellant filed their manifestations stating that they were no longer filing any supplemental brief and that they were adopting their respective briefs filed before the CA as their supplemental briefs considering that the Brief for the Appellee and the Brief for the Accused-Appellant had adequately discussed the issues and arguments raised by the parties.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the appeal is DISMISSED. Accordingly, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals in its April 23, 2014 Decision, in CA-G.R. CR-HC No. 05944, finding accused-appellant Jubaynai Malaguit y Moreno GUILTY beyond reasonable doubt of having violated Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment and a fine of Five Hundred Thousand Pesos (P500,000.00), for the illegal sale of 0.09 gram of Methylamphetamine Hydrochloride; and of having violated Section 11, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of imprisonment from Twelve (12) Years and One (1) Day, as minimum, to Fourteen (14) Years, as maximum, and a fine of Three Hundred Thousand Pesos (P300,000.00) for the illegal possession of 0.04 gram of Methylamphetamine Hydrochloride.
