NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated February 20, 2019 which reads as follows:
"G.R. No. 232575 — People of the Philippines, plaintiff-appellee, v. Peter Macasa y Dapitan, accused-appellant.
After a careful review of the records of the case, the Court finds the appeal to be lacking in merit. We therefore adopt the findings of the trial court as affirmed by the Court of Appeals. The Regional Trial Court of San Mateo, Rizal, Branch 76 and the Court of Appeals correctly found Peter Macasa y Dapitan guilty beyond reasonable doubt of the crime of murder for killing Nelia Villasin qualified by abuse of superior strength and accordingly sentenced him to suffer the penalty of reclusion perpetua. The awards of civil indemnity in the amount of PhP75,000.00, moral damages in the amount of PhP75,000.00, and exemplary damages in the amount of PhP75,000.00, are proper. Temperate damages in the amount of PhP50,000.00, shall also be awarded in lieu of actual damages. Moreover, interest shall be imposed on all monetary awards at the rate of 6% per annum from date of finality of judgment until fully paid.
WHEREFORE, the appeal is DISMISSED. The March 6, 2017 Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 08145 finding appellant Peter Macasa y Dapitan guilty beyond reasonable doubt of the crime of murder and sentencing him to suffer the penalty of reclusion perpetua and ordering him to pay the heirs Nelia Villasin, civil indemnity in the amount of PhP75,000.00, moral damages in the amount of PhP75,000.00, exemplary damages in the amount of PhP75,000.00, is AFFIRMED with MODIFICATION that temperate damages in the amount of PhP50,000.00 shall also be paid by appellant to the heirs of Nelia Villasin and interest shall be imposed on all the monetary awards at the rate of 6% per annum from date of finality of this Resolution until fully paid.
