NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 19 October 2015which reads as follows:
"G.R. No. 216983 (People of the Philippines v. Rolly Lobusta y Vunggi).
The records of this case were elevated to this Court on March 17, 2015, pursuant to the Resolution 1 of the Court of Appeals (CA), dated October 22, 2014, which gave due course to the notice of appeal filed by the accused-appellant, Rolly Lobusta y Vunggi.
The Court then issued its Resolution, 2 dated July 1, 2015, directing both parties to submit their supplemental briefs, if they so desired. On August 25, 2015, the Office of the Solicitor General (OSG), filed a manifestation and motion 3 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised. On October l, 2015, the accused-appellant filed a manifestation, in lieu of supplemental brief 4 averring that he would adopt his Appellant's Brief filed before the CA.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the appeal is DISMISSED. The September 4, 2014 Decision of the Court of Appeals in CA-G.R. CR. HC No. 06063, finding accused-appellant Rolly Lobusta y Vunggi GUILTY beyond reasonable doubt of Violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment, and to pay a fine of Five Hundred Thousand Pesos P500,000.00) is hereby AFFIRMED.
