NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 23 November 2015 which reads as follows:
"G.R. No. 207537 — People of the Philippines, plaintiff-appellee, v. Dominador Lagera y Costales, defendant-appellant.
After a thorough review of the records of this case, the Court finds the appeal to be lacking in merit. We therefore adopt the findings of facts of the trial court as affirmed by the Court of Appeals. The Regional Trial Court of Urdaneta City, Pangasinan, Branch 49 and the Court of Appeals correctly found appellant Dominador Lagera y Costales guilty beyond reasonable doubt of two counts of rape in Criminal Case Nos. U-13351-52 and sentenced him to suffer the penalty of reclusion perpetua in each case. Moreover, the awards of civil indemnity and moral damages in the amount of P75,000.00 each, for each count, and exemplary damages in the amount of P30,000.00 for each count, are proper and in line with prevailing jurisprudence. Interest at the rate of 6% per annum shall be imposed on all damages awarded from the date of finality of this Resolution until fully paid.
WHEREFORE, we ADOPT the findings of the trial court as affirmed by the Court of Appeals. The assailed January 25, 2013 Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 05246 affirming with modifications the February 14, 2011 Judgment of the Regional Trial Court of Urdaneta City, Pangasinan, Branch 49 finding appellant Dominador Lagera y Costales guilty beyond reasonable doubt of two (2) counts of rape in Criminal Case Nos. U-13351-52 and sentencing him to suffer the penalty of reclusion perpetua for each count is AFFIRMED.
