NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated20 November 2019which reads as follows:
"G.R. No. 241943 (People of the Philippines v. Christian A. Labastida). — Considering the allegations, issues and arguments presented in the Appellant's and the Appellee's Briefs which the parties adopted instead of filing their respective Supplemental Briefs, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision 1 dated June 29, 2018, as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated June 29, 2018 of the Court of Appeals in CA-G.R. CR-HC No. 01644-MIN, and AFFIRMS the said Decision finding Christian A. Labastida guilty beyond reasonable doubt of the crime of murder defined and penalized under Article 248 of the Revised Penal Code, sentencing him to suffer the penalty of reclusion perpetua, and ordering him to pay the private complainant Mary Ann M. Rama the following: (1) actual damages in the amount of P100,000.00; (2) civil indemnity, moral damages, and exemplary damages in the amount of P75,000.00 each; and (3) attorney's fees in the amount of P75,000.00. All monetary awards shall earn legal interest at the rate of 6% per annum from the date of finality of the resolution until fully paid. CAIHTE
