Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 22 September 2014which reads as follows:
G.R. No. 210711 — People of the Philippines v. Victorino Jaime alias "Junior." TCacIE
The records of this case were elevated to this Court on January 10, 2014, pursuant to the Resolution of the Court of Appeals (CA), dated December 4, 2013, which gave due course to the Notice of Appeal filed by the accused-appellant, Victorino Jaime alias "Junior."
The Court resolves to:
(1) GRANT the Second and Third Motions for Extension to file Appellee's Brief filed by the Office of the Solicitor General;
(2) NOTE the Appellee's Brief, dated July 23, 2014, filed by the Office of the Solicitor General; and
(3) DISMISS the appeal of the accused-appellant for his failure to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
Thus, the July 25, 2013 Decision of the CA is affirmed with modification, increasing the award of civil indemnity from P50,000.00 to P75,000.00 and awarding moral damages in the amount of Seventy-Five Thousand Pesos (P75,000.00) and exemplary damages in the amount of Thirty Thousand Pesos (P30,000.00), in line with jurisprudence. WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law of the Court of Appeals in its July 25, 2013 Decision in CA-G.R. CEB CR-HC No. 01396, finding the accused-appellant, Victorino Jaime alias "Junior" GUILTY beyond reasonable doubt of the crime of Murder, as defined and penalized under Article 248 of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua with the accessory penalties provided by law, and to pay the heirs of the victim the amount of Fifty Thousand Pesos (P50,000.00) as actual damages; Seventy-Five Thousand Pesos (P75,000.00) as civil indemnity; Seventy-Five Thousand Pesos (P75,000.00) as moral damages; and Thirty Thousand Pesos (P30,000.00) as exemplary damages with 6% per annum interest until fully paid.
