NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated09 November 2020which reads as follows:
"G.R. No. 251361 (People of the Philippines v. Jamel Ismael y Dinarao, Romnick Riga y Mamao, and Mujib Abdulhamid y Mortal). — The Court NOTES the manifestation (in lieu of supplemental brief) dated 7 October 2020 of the Office of the Solicitor General, adopting its brief filed before the Court of Appeals (CA) as supplemental brief, since the same had adequately discussed all the matters pertinent to plaintiff-appellee.
After a judicious study of the case, the Court resolves to DISMISS the appeal 1 for failure to sufficiently show that the CA committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the September 25, 2018 Decision 2 of the CA in CA-G.R. CR-HC No. 08245 and AFFIRMS said Decision finding: (a) accused-appellants Jamel Ismael y Dinarao, Romnick Riga y Mamao, and Mujib Abdulhamid y Mortal (Abdulhamid; collectively, accused-appellants) GUILTY beyond reasonable doubt of the crime of Illegal Sale of Dangerous Drugs, defined and penalized under Section 5, Article II of Republic Act No. (RA) 9165, 3 otherwise known as the 'Comprehensive Dangerous Drugs Act of 2002'; and (b) Abdulhamid GUILTY beyond reasonable doubt of the crime of Illegal Possession of Dangerous Drugs, defined and penalized under Section 11, Article II of RA 9165. Accordingly, accused-appellants are sentenced as follows: (i) for the crime of Illegal Sale of Dangerous Drugs, accused-appellants are each sentenced to suffer the penalty of life imprisonment, and to pay a fine in the amount of P500,000.00; and (ii) for the crime of Illegal Possession of Dangerous Drugs, Abdulhamid is sentenced to suffer the penalty of life imprisonment, and to pay a fine in the amount of P500,000.00.
