NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJanuary 29, 2020, which reads as follows:
"G.R. No. 246584 (PEOPLE OF THE PHILIPPINES, plaintiff-appellee v. BIENVENIDO HERNANDEZ y LEE, accused-appellant). — The Court of Appeals elevated the records of this case to this Court in compliance with its January 10, 2018 Resolution, 1 which gave due course to the Notice of Appeal 2 filed by accused-appellant Bienvenido Hernandez y Lee.
In its July 1, 2019 Resolution, 3 this Court noted the records of this case forwarded by the Court of Appeals. This Court also informed accused-appellant and plaintiff-appellee, through the Office of the Solicitor General, that they may file their supplemental briefs.
Separate Manifestations 4 have since been filed by accused-appellant and plaintiff-appellee, stating that they would no longer submit supplemental briefs. HTcADC
After an evaluation of the case records, this Court resolves to DISMISS the appeal of accused-appellant for his failure to sufficiently show any reversible error in the assailed October 24, 2017 Decision 5 of the Court of Appeals, warranting the exercise of this Court's appellate jurisdiction.
WHEREFORE, this Court ADOPTS the findings of fact and conclusions of law of the Regional Trial Court and of the Court of Appeals. The Court of Appeals' October 24, 2017 Decision in CA-G.R. CR HC No. 08854 is AFFIRMED. Accused-appellant Bienvenido Hernandez y Lee is sentenced to suffer the penalty of life imprisonment and ordered to pay a fine of P500,000.
