Please take notice that the Court, First Division, issued a Resolution datedNovember 10, 2014which reads as follows: HTcADC
"G.R. No. 207390 (People of the Philippines v. Laurencio Guazon y Carino). — After a judicious perusal of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in convicting accused-appellant Laurencio Guazon y Carino of the crime of Qualified Rape, under paragraph 1 (a), Article 266-A, in relation to Article 266-B (1) of the Revised Penal Code (RPC).
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the June 29, 2012 Decision 1 of the CA in CA-G.R. CR HC No. 04991 and AFFIRMS said Decision finding accused-appellant Laurencio Guazon y Carino GUILTY beyond reasonable doubt of the crime of Qualified Rape, in violation of paragraph 1 (a), Article 266-A, in relation to Article 266-B (1) of the RPC, as amended, with MODIFICATION as to the awards of damages, thereby sentencing him to suffer the penalty of reclusion perpetua, without eligibility for parole, and ordering him to pay the private complainant the following amounts: (a) P100,000.00 as civil indemnity; (b) P100,000.00 as moral damages; and (c) P100,000.00 as exemplary damages, in line with prevailing jurisprudence. 2 In addition, legal interest at the rate of six percent (6%) per annum shall be imposed from the finality of this judgment until fully paid.
