NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated September 11, 2013, which reads as follows:
"G.R. No. 205229 (People of the Philippines v. Antonio Griño y Hiligan). — The records of this case were elevated to this Court on February 1, 2013, pursuant to the Resolution of the Court of Appeals, dated May 23, 2012, which gave due course to the notice of appeal filed by the accused, Antonio Griño y Hiligan.
The Court resolves to:
(1) NOTE the Manifestation in Lieu of Supplemental Brief filed by the accused stating that he has decided not to file a supplemental brief as the appellant's brief addressed all the issues regarding his defense; and
(2) DISMISS the appeal of the accused for his failure to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction. ISDHcT
Thus, the decision of the Court of Appeals is affirmed with the modification that the civil indemnity be increased from Seventy Five Thousand Pesos (P75,000.00) to One Hundred Thousand Pesos (P100,000.00) and exemplary damages in the amount of Thirty Thousand Pesos (P30,000.00) be awarded in line with recent jurisprudence. 1
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals' in its April 27, 2012 Decision in CA G.R. CR-HC No. 02432, finding accused Antonio Griño y Hiligan GUILTY beyond reasonable doubt of the crime of Rape with Homicide as defined and penalized under Article 335 of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua, without the benefit of parole, and to pay the heirs of the victim the amount of One Hundred Thousand Pesos (P100,000.00) as civil indemnity, Seventy Five Thousand Pesos (P75,000.00) as moral damages and Thirty Thousand Pesos (P30,000.00) as exemplary damages.
