NOTICE
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated05 July 2017 which reads as follows:
"G.R. No. 227161 — (People of the Philippines v. Jessie Lauro (at large) and Rolando Gomiloy y Cordova, accused; Rolando Gomiloy y Cordova, accused-appellant)
The records of this case were elevated to this Court on October 10, 2016 pursuant to the Court of Appeals, Cagayan de Oro City (CA) Resolution, 1 dated August 17, 2016, in CA-G.R. CR HC No. 01371-MIN, which gave due course to the notice of appeal filed by Rolando Gomiloy y Cordova (accused-appellant).
In a Resolution, 2 dated December 7, 2016, the Court required the parties to submit their respective supplemental briefs, if they so desire, within thirty (30) days from notice.
In its Manifestation (In Lieu of Supplemental Brief), 3 dated February 14, 2017, the Office of the Solicitor General (OSG) manifested that it would dispense with the filing of a Supplemental Brief because no significant transaction, occurrence or event have transpired since the filing of its Appellee's Brief before the CA. In his Manifestation in lieu of Supplemental Brief, 4 dated February 14, 2017, accused-appellant stated that he would no longer file a Supplemental Brief considering that the Appellant's Brief filed before the CA already contains the full amplification of his arguments in the present case. After a perusal of the records of the case, the Court finds that accused-appellant failed to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the appeal is DISMISSED. The October 20, 2014 Decision of the Regional Trial Court, Branch 4, Butuan City in Criminal Case No. 14284 finding accused Rolando Gomiloy y Cordova guilty beyond reasonable doubt for violation of Section 5, Article II of Republic Act No. 9165 and sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 is hereby AFFIRMED in toto.
