PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. JOBERT GOMBA Y CASOCO @ BOY ILLADO, accused-appellants.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 02 March 2016 which reads as follows:
"G.R. No. 220493 (People of the Philippines v. Jobert Gomba y Casoco @ Boy Illado).
The records of this case were elevated to this Court on October 9, 2015, pursuant to the February 5, 2015 Resolution 1 of the Court of Appeals (CA) which gave due course to the notice of appeal filed by accused-appellant Jobert Gomba y Casoco alias "Boy Illado" (accused-appellant).
The Court then issued its November 25, 2015 2 Resolution which directed both parties to submit their supplemental briefs, if they so desired. On January 25, 2016, accused-appellant filed a manifestation, in lieu of supplemental brief, 3 averring that he would adopt his Appellant's Brief filed before the CA. On February 2, 2016, the Office of the Solicitor General filed a manifestation 4 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals in its November 17, 2014 Decision in CA-G.R. CR-HC No. 05719, finding accused-appellant Jobert Gomba y Casoco alias "Boy Illado" GUILTY beyond reasonable doubt of:
1] Violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of Life Imprisonment, and to pay a fine of Five Hundred Thousand Pesos (P500,000.00); and
2] Violation of Section 15, Article II of Republic Act No. 9165, and sentencing him to Six (6) months of rehabilitation in a government center. (Brion, J., on leave)
