NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated November 10, 2021, which reads as follows:
"G.R. No. 243393 (PEOPLE OF THE PHILIPPINES, plaintiff-appellee v. DEXTER ESTRADA Y MABALE, accused-appellant). — The Court of Appeals elevated the records of this case pursuant to its Resolution, 1 which gave due course to the Appeal filed by Dexter Estrada.
In a Resolution, 2 we noted the records forwarded by the Court of Appeals. We also notified the parties that they may file their supplemental briefs within 30 days from notice.
Plaintiff-appellee, represented by the Office of the Solicitor General, filed a Manifestation, 3 stating that it was dispensing with the filing of the supplemental brief as it had already exhaustively discussed its arguments in its Brief for the Appellee 4 filed before the Court of Appeals. A similar Manifestation 5 was filed by accused-appellant.
After evaluating the records of this case, we resolve to affirm the conviction of accused-appellant.
There is no reversible error in the assailed Court of Appeals Decision 6 that would warrant the exercise of this Court's appellate jurisdiction.
However, in line with the current jurisprudence, 7 all damages awarded shall earn interest at the rate of 6% per annum from the date of finality of judgment until full payment.
WHEREFORE, the findings of fact and conclusions of law of the Court of Appeals are ADOPTED. The November 21, 2017 Decision of the Court of Appeals in CA-G.R. CR-HC NO. 08646 is AFFIRMED with MODIFICATION.
Accused-appellant Dexter Estrada y Mabale is found GUILTY beyond reasonable doubt of the crime of rape. He is sentenced to suffer the penalty of reclusion perpetua and pay private complainant AAA civil indemnity, moral damages, and exemplary damages at P100,000.00 each, and the costs of the suit.
In line with the current jurisprudence, an interest at the rate of 6% per annum is imposed on all damages awarded from the date of the finality of this Resolution until fully paid. ISHCcT
