SECOND DIVISION
[G.R. No. 221441. June 20, 2016.]
PEOPLE OF THE PHILIPPINES, plaintiff-appellee,vs. NEMESIO ERAMIS, JR. Y JAKOSALEM AND ALDRIN DINGLASA Y LINOGO, accused-appellants.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated20 June 2016which reads as follows:
"G.R. No. 221441 — (People of the Philippines v. Nemesio Eramis, Jr. y Jakosalem and Aldrin Dinglasa y Linogo).
The records of this case were elevated to this Court on December 3, 2015, pursuant to the Resolution of Court of Appeals (CA), dated September 18, 2015, which gave due course to the notice of appeal filed by the accused-appellants, Nemesio Eramis, Jr. y Jakosalem and Aldrin Dinglasa y Linogo.
The Court then issued its Resolution, dated January 27, 2016, which required both parties to submit their supplemental briefs, if they so desired. On April 29, 2016, the accused-appellants filed their Manifestation in Lieu Supplemental Brief, dated April 15, 2016, stating that they would no longer file their supplemental brief and, instead, adopted their Appellants' Brief, dated February 3, 2014, filed before the CA as the same had already exhaustively discussed the legal issues and arguments. Likewise, on March 15, 2016 the Office of the Solicitor General filed its Manifestation in Lieu of Supplemental Brief, averring that it was also adopting its Appellee's Brief, dated June 25, 2014, because filing a supplemental brief would only be repetitious and would amount to trifling with the precious time of the Court.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellants to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the appeal is DISMISSED. The June 30, 2015 Decision of the Court of Appeals in CA-G.R. CEB C.R.-HC No. 01733, denying the accused-appellants' appeal and affirming with modification the August 6, 2013 Order of the Regional Trial Court, Branch 45, Bais City, 7th Judicial Region, in Criminal Case No. 08-099-B, is SUSTAINED.
SO ORDERED. (Del Castillo, J., on official leave)"
Very truly yours,
MA. LOURDES C. PERFECTODivision Clerk of Court
