Please take notice that the Court, Second Division, issued a Resolution dated16 April 2018which reads as follows: cHaCAS
"G.R. No. 234326 (People of the Philippines v. Calixta Villaber Empaces @ "Alice")
After a judicious study of the case, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the April 7, 2017 Decision 1 of the CA in CA-G.R. CR HC No. 02135 and AFFIRMS said Decision, finding accused-appellant Calixta Villaber Empaces @ "Alice" GUILTY beyond reasonable doubt of the crime of Illegal Sale and Illegal Possession of Dangerous Drugs, as defined and penalized under Sections 5 and 11, respectively, of Republic Act No. 9165, 2 otherwise known as the "Comprehensive Dangerous Drugs Act of 2002." Accordingly, for: (a) Illegal Sale of Dangerous Drugs, she is sentenced to suffer the penalty of life imprisonment and ordered to pay a fine of P500,000.00; and (b) for Illegal Possession of Dangerous Drugs, she is sentenced to suffer the penalty of imprisonment of twenty (20) years and one (1) day to life imprisonment, and ordered to pay a fine of P400,000.00.
SO ORDERED."
