Please take notice that the Court, First Division, issued a Resolution datedJune 27, 2018which reads as follows: HTcADC
"G.R. No. 234946 (People of the Philippines v. Ronel Dulva y Hular and Roland Esperida y Detera). — After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in upholding the conviction of Ronel Dulva y Hular and Roland Esperida y Detera for the crime of murder.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated August 10, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 08445 and AFFIRMS the Decision finding accused-appellants Ronel Dulva y Hular and Roland Esperida y Detera GUILTY beyond reasonable doubt of murder defined and penalized under Article 248 of the Revised Penal Code, and sentencing them to suffer the penalty of reclusion perpetua with all its accessory penalties, and to solidarily pay the heirs of the victim P28,000.00 as actual damages, and P75,000.00 as civil indemnity, with the MODIFICATION that the award of moral damages is increased to P75,000.00. In addition, the interest at the rate of 6% per annum shall be imposed on all damages awarded computed from the finality of this judgment until their full satisfaction. aCIHcD
The Office of the Solicitor General's manifestation in lieu of supplemental brief (re: Resolution dated January 19, 2018), stating that it will no longer file a supplemental brief, since the legal issues and arguments of the appellee were exhaustively discussed in its Appellee's Brief dated April 21, 2017 filed before the Court of Appeals; and the accused-appellants' manifestation (in lieu of supplemental brief), pursuant to the Resolution dated January 19, 2018, stating that the Appellants' Brief dated January 13, 2017 filed with the Court of Appeals had exhaustively discussed the assigned errors, thus they are dispensing with the filing of a supplemental brief and adopting the said brief as their supplemental brief are both NOTED.
