Please take notice that the Court, Second Division, issued a Resolution dated22 November 2017which reads as follows: AaCTcI
"G.R. No. 223096: PEOPLE OF THE PHILIPPINES v. ROLAND "TEREK" DIESTRO, JOSE "JOE" AGUIRRE and ROLAND "TANKAD" VILLARUEL, accused; ROLAND "TEREK" DIESTRO, accused-appellant.
After a careful review of the records of the case, the Court finds no reversible error in the assailed decision. However, the amount of exemplary and moral damages should be increased to P75,000 each, pursuant to prevailing jurisprudence. 1 As correctly held by the Court of Appeals, interest at the rate of 6% per annum is imposed on all damages awarded from the date of finality of this Resolution until fully paid.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the attached Decision dated 4 March 2015 of the Court of Appeals in CA-G.R. CR-H.C. No. 06279. The Decision finding appellant Roland "Terek" Diestro guilty of murder is AFFIRMED with the MODIFICATION that the amount of exemplary and moral damages is increased to P75,000 each. Interest at the rate of 6% per annum is imposed on all damages awarded from the date of finality of this Resolution until fully paid.
