Please take notice that the Court, Third Division, issued a Resolution dated September 10, 2014, which reads as follows:
"G.R. No. 198876 (People of the Philippines v. Henry Dela Vega y De Jesus and Claudio Capin y Babilonia) — Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated March 29, 2011 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated March 29, 2011 of the Court of Appeals in CA-G.R. CR-HC No. 03144 and AFFIRMS said Decision finding appellants Henry Dela Vega y De Jesus and Claudio Capri y Babilonia guilty beyond reasonable doubt of the crime of Murder, as defined and penalized under Article 248 of the Revised Penal Code, as amended by Republic Act No. 7659, sentencing both of them to suffer the penalty of imprisonment of reclusion perpetua and to pay, jointly and severally, the heirs of the victim the amounts of P50,000.00 as civil indemnity, P50,000.00 as moral damages, P14,920.00 as actual damages and P15,000.00 as nominal damages with MODIFICATION that the appellants are hereby ORDERED to PAY the heirs of the victim the additional amount of P30,000.00 as exemplary damages in view of prevailing jurisprudence.
