Please take notice that the Court, Third Division, issued a Resolution datedJanuary 31, 2018, which reads as follows: TAIaHE
"G.R. No. 215941 (People of the Philippines, plaintiff-appellee v. Desiderio Dela Cruz, accused-appellant.) — The Court of Appeals elevated the records of this case to this Court on January 23, 2015 pursuant to its November 12, 2014 Resolution, 1 which gave due course to the Notice of Appeal 2 filed by accused-appellant Desiderio Dela Cruz (Dela Cruz).
In its April 22, 2015 Resolution, 3 this Court noted the records of this case forwarded by the Court of Appeals and informed the parties that they may file their supplemental briefs.
In its June 29, 2015 Resolution, 4 this Court noted the Manifestation filed by the Office of the Solicitor General 5 noting that it would no longer file a supplemental brief.
In its August 17, 2015 Resolution, 6 this Court noted accused-appellant's Manifestation, 7 stating that he would no longer file a supplemental brief.
After an evaluation of the records of this case, this Court resolves to DISMISS the appeal of accused-appellant Dela Cruz for his failure to sufficiently show reversible error in the assailed Court of Appeals September 29, 2014 Decision 8 warranting the exercise of this Court's appellate jurisdiction.
WHEREFORE, this Court ADOPTS the findings of fact and conclusions of law of the Regional Trial Court and of the Court of Appeals. The Court of Appeals September 29, 2014 Decision in CA-G.R. CR-HC No. 01183 is hereby AFFIRMED in toto. This Court finds accused-appellant Desiderio Dela Cruz GUILTY beyond reasonable doubt of the crime of MURDER.
All monetary awards for damages shall earn interest at the legal rate of six percent (6%) per annum from the date of the finality of the judgment in this case until fully paid.
