NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 30 July 2018which reads as follows:
"G.R. No. 226155 (People of the Philippines vs. Jaime Cortero y Orlain). — After an exhaustive review of the allegations, issues and arguments presented by the parties, the Court resolves to DISMISS the appeal for failure to sufficiently prove that the Court of Appeals committed a reversible error in its disputed Decision 1 dated July 7, 2015 in CA-G.R. CR HC No. 05238 as to warrant the exercise of the Court's discretionary appellate jurisdiction.
WHEREFORE, the Decision dated July 7, 2015 of the Court of Appeals in CA-G.R. CR HC No. 05238, finding accused-appellant Jaime Cortero y Orlain guilty beyond reasonable doubt of the crime of Murder, is hereby AFFIRMED with MODIFICATION in that the award of exemplary damages is increased to P75,000.00. DETACa
Accused-appellant Jaime Cortero y Orlain is further ORDERED to pay the heirs of victim Tomas Penaso interest on all the damages awarded at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid.
