Please take notice that the Court, Third Division, issued a Resolution dated January 23, 2019, which reads as follows:
"G.R. No. 237358 (People of the Philippines vs. Danilo R. Catacutan, Roel M. Vergara, Abelardo Ocampo and Charlie Ocampo, accused; Danilo R. Catacutan, accused-appellant). — It appearing from the records of this case that accused-appellant Danilo R. Catacutan is detained at the Pampanga Provincial Jail, San Fernando, Pampanga, the Court REQUIRES the Jail Warden of the Pampanga Provincial Jail, San Fernando, Pampanga, to IMMEDIATELY TRANSFER accused-appellant to the New Bilibid Prison, Bureau of Corrections, Muntinlupa City.
This is an appeal 1 pursuant to Section 3 (c), Rule 124 of the Rules of Court, as amended seeking to annul and set aside the Decision 2 dated September 29, 2017 issued by the Court of Appeals (CA) in CA-G.R. CR-H.C. No. 08769.
After a perusal of the records of this case, the Court resolves to DISMISS the appeal for failure to sufficiently show any reversible error in the herein assailed CA decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS and AFFIRMS the factual findings and conclusions of law in the Decision dated September 29, 2017 issued by the Court of Appeals in CA-G.R. CR-H.C. No. 08769 finding accused-appellant Danilo R. Catacutan guilty beyond reasonable doubt of the special complex crime of Kidnapping for Ransom with Homicide thereby imposing upon him the penalty of reclusion perpetua without eligibility for parole; and adjudging him liable for civil indemnity, moral damages, and exemplary damages pegged at Php100,000.00 each, as well as temperate damages in the amount of Php50,000.00. The award of damages shall earn interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid.
