NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated January 23, 2019, which reads as follows:
"G.R. No. 238335 (People of the Philippines v. Lovelyn Castor y Sapida). — Considering the allegations, issues and arguments raised in the Appellant's and the Appellee's Briefs, which they adopted instead of filing their Supplemental Briefs, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated September 19, 2017, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings of fact and conclusions of law in the attached Court of Appeals Decision dated September 19, 2017 in CA-G.R. CR-HC No. 08695. The said Decision, affirming the conviction of accused-appellant Lovelyn Castor y Sapida of the Crime of Kidnapping and Failure to Return a Minor, as defined and penalized under Article 270 of the Revised Penal Code, as amended, and sentencing her to suffer the penalty of reclusion perpetua, is AFFIRMED with MODIFICATION that she is hereby ORDERED to PAY the private complainant, mother of HHH, moral damages of P75,000.00, nominal damages of P75,000.00, and exemplary damages of P75,000.00, pursuant to Articles 2219, 2221 and 2229 of the Civil Code of the Philippines, respectively, with legal interest at the rate of six percent (6%) per annum from finality of this Resolution until fully paid.
