NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 14 October 2015which reads as follows:
"G.R. No. 206057 — People of the Philippines, plaintiff-appellee, v. Victor Vicente Casquio y Morilla, accused-appellant.
After a careful review of the records of this case, the Court finds the appeal to be lacking in merit. We therefore adopt the findings of facts of the trial court as affirmed by the Court of Appeals. The Regional Trial Court of Santa Cruz, Laguna, Branch 26 and the Court of Appeals correctly found appellant Victor Vicente Casquio y Morilla guilty beyond reasonable doubt of the crime of rape in Criminal Case Nos. SC-8554-56 and sentenced him to suffer the penalty of reclusion perpetua for each count. Moreover, the award of moral damages in the amount of P75,000.00 for each count, is proper. However, the awards of civil indemnity and exemplary damages in the amounts of P50,000.00 and P20,000.00, respectively, must be increased to P75,000.00 and P30,000.00, respectively, for each count, in line with prevailing jurisprudence. Interest at the rate of 6% per annum shall be imposed on all damages awarded from the date of finality of this Resolution until fully paid.
WHEREFORE, we ADOPT the findings of the trial court as affirmed by the Court of Appeals. The assailed September 21, 2012 Decision of the Court of Appeals in CA-G.R. CR.-H.C. No. 04108 affirming the July 29, 2009 Decision of the Regional Trial Court of Santa Cruz, Laguna, Branch 26 finding appellant Victor Vicente Casquio y Morilla guilty beyond reasonable doubt of three (3) counts of rape in Criminal Case Nos. SC-8554-56 and sentencing him to suffer the penalty of reclusion perpetua for each count is AFFIRMED with MODIFICATIONS that the awards of civil indemnity and exemplary damages are increased to P75,000.00 and P30,000.00, respectively, for each count, and interest at the rate of 6% per annum is imposed on all damages awarded from the finality of this Resolution until full payment.
