Please take notice that the Court, First Division, issued a Resolution dated September 22, 2014which reads as follows:
"G.R. No. 209226 (People of the Philippines v. Garnet Cadley y Ciano, Jun Dangle y Pacnisen, and Danny Tulabis y Alsiba).
After a judicious review of the records, the Court resolves to DISMISS the appeal for failure to show that the Court of Appeals (CA) committed any reversible error in its assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the February 29, 2012 Decision 1 of the CA in CA-G.R. CR-H.C. No. 03863 and AFFIRMS said Decision finding: (1) accused-appellants Garnet Cadley y Ciano, Jun Dangle y Pacnisen, and Danny Tulabis y Alsiba GUILTY beyond reasonable doubt of violating Section 26 in relation to Section 5, Article II of Republic Act No. (RA) 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002," sentencing them to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 in Criminal Case No. 26129-R; (2) Jun Dangle y Pacnisen GUILTY beyond reasonable doubt of violating Section 11, Article II of RA 9165, sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 in Criminal Case No. 26130-R; and (3) Danny Tulabis y Alsiba GUILTY beyond reasonable doubt of violating Section 11, Article II of RA 9165, sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 in Criminal Case No. 26131-R.
