NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated17 October 2018which reads as follows:
"G.R. No. 228883 (People of the Philippines v. Eddie Bonalos y Estoesta)
After a careful review of the records of the case, the Court finds no reversible error in the assailed decision. However, the award of damages should be modified pursuant to prevailing jurisprudence. 1 Accordingly, exemplary damages in the amount of P75,000.00 should also be awarded.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the attached Decision of the Court of Appeals in CA-G.R. CR HC No. 05388 promulgated on 20 March 2015. The Decision finding appellant Eddie Bonalos y Estoesta guilty beyond reasonable doubt of the crime of statutory rape in Criminal Case Nos. 25934-R and 25930-R, as defined in Article 266-A, par. 1 (d) of the Revised Penal Code, as amended by Republic Act No. 8353, and of the crime of rape in Criminal Case Nos. 25931-R and 25933-R, as defined in Article 266-A, par. 1 (a) of the Revised Penal Code, and sentencing him to suffer the penalty of reclusion perpetua and all its accessory penalties in all four cases is AFFIRMED with the MODIFICATION that exemplary damages in the amount of P75,000.00 is also awarded per count, in addition to the previously awarded amounts of P75,000.00 as civil indemnity ex delicto and P75,000.00 as moral damages for each of the four counts. As with the civil indemnity and moral damages, legal interest on exemplary damages is likewise awarded to AAA 2 at the rate of 6% per annum from the date of finality of this Resolution until fully paid.
