NOTICE

Please take notice that the Court, First Division, issued a Resolution dated October 1, 2018which reads as follows:
"G.R. No. 234644 (People of the Philippines v. Cresent Bocboc y Zapanta). — After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in upholding the conviction of accused-appellant Cresent Bocboc y Zapanta for violation of Section 5, Article II of Republic Act No. 9165, also known as the Comprehensive Dangerous Drugs Act of 2002.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated June 27, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 01545-MIN and AFFIRMS said Decision finding accused-appellant Cresent Bocboc y Zapanta GUILTY beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 without subsidiary imprisonment in case of insolvency.
The accused-appellant's manifestation in lieu of supplemental brief, pursuant to the Resolution dated January 11, 2018, stating that he will no longer file a supplemental brief since he has already thoroughly discussed his arguments in his Appellant's Brief is NOTED. DETACa
