NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated September 24, 2014which reads as follows:
"G.R. No. 206325 (People of the Philippines v. Nonilon Berino y Arimala). — After a judicious perusal of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its assailed Decision as to warrant the exercise of the Court's appellate jurisdiction. The Court, however, deems it proper to increase the award of moral damages from P50,000.00 to P75,000.00 to conform with prevailing jurisprudence. 1
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the May 31, 2012 Decision 2 of the CA in CA-G.R. CR-H.C. No. 04480 and AFFIRMS said Decision finding accused-appellant Nonilon Berino y Arimala GUILTY beyond reasonable doubt of the crime of murder in violation of Article 248 of the Revised Penal Code, with MODIFICATIONS as to the award of moral damages and eligibility for parole, sentencing him to suffer the penalty of reclusion perpetua, without eligibility for parole, and to indemnify the heirs of the victim the following amounts: (a) P75,000.00 as civil indemnity; (b) P75,000.00 as moral damages; (c) P30,000.00 as exemplary damages; and (d) P25,000.00 as temperate damages, with interest at the rate of six percent (6%) per annum reckoned from the finality of this Decision until fully paid.
