SECOND DIVISION
[G.R. No. 245305. June 22, 2020.]
PEOPLE OF THE PHILIPPINES, plaintiff-appellee,vs. BBB, accused-appellant.
NOTICE
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated22 June 2020which reads as follows:
"G.R. No. 245305 (People of the Philippines v. BBB). — The records of this case were elevated to this Court on 15 March 2019, pursuant to the Court of Appeals Resolution dated 07 February 2019, which gave due course to the notice of appeal filed by accused-appellant BBB.
In compliance with the Court's Resolution dated 10 April 2019, both parties filed their respective manifestations, the Office of the Solicitor General's Manifestation dated 24 June 2019, stating that it sees no cogent reason to file a supplemental brief as it believes that it has already extensively discussed the relevant issues in the appellee's brief; and the accused-appellant's manifestation in lieu of supplemental brief dated 03 July 2019, adopting the appellant's brief as the same has adequately discussed all the matters pertinent to his defense.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of accused-appellant to sufficiently show any reversible error in the challenged Decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated 27 November 2018 of the Court of Appeals in CA-G.R. CR-HC No. 02335, finding accused-appellant BBB guilty beyond reasonable doubt of five (5) counts of Qualified Rape, and AFFIRMS said Decision in toto.
SO ORDERED." (J. Gaerlan, designated Additional Member per Special Order No. 2780 dated May 11, 2020, on leave.)
Very truly yours,
(SGD.) TERESITA AQUINO TUAZONDeputy Division Clerk of Court
