G.R. No. 236452 (Notice)

This is a criminal case, People of the Philippines v. Arnel Baylon y Miravelles @ "Bakos", decided by the Supreme Court of the Philippines on September 7, 2020. The accused-appellant was found guilty beyond reasonable doubt of rape with homicide and was sentenced to suffer the penalty of reclusion perpetua without eligibility of parole. The Supreme Court dismissed the appeal for failure to show any reversible error committed by the Court of Appeals. The accused-appellant was also ordered to pay the heirs of the victim civil indemnity, moral damages, exemplary damages, and temperate damages, with legal interest. The victim's identity was kept confidential in accordance with the rules on confidentiality of records and court proceedings.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, Second Division, issued a Resolution dated07 September 2020which reads as follows:

"G.R. No. 236452 (People of the Philippines v. Arnel Baylon y Miravelles @ "Bakos"). — After a judicious study of the case, the Court resolves to DISMISS the appeal 1 for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.

WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision 2 dated 27 June 2017 of the CA in CA-G.R. CR-HC No. 07957 and AFFIRMS the Decision finding Arnel Baylon y Miravelles @ "Bakos" (appellant) GUILTY beyond reasonable doubt of the crime of Rape with Homicide. Accordingly, appellant is sentenced to suffer the penalty of reclusion perpetua3 without eligibility of parole, 4 and to pay the heirs of AAA 5 the amounts: (a) P100,000.00 as civil indemnity; (b) P100,000.00 as moral damages; (c) P100,000.00 as exemplary damages; and (d) P50,000.00 as temperate damages. Moreover, all monetary awards shall earn an interest at the legal rate of six percent (6%) per annum from the date of finality of this Resolution until full payment. ATICcS
