NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJune 22, 2020, which reads as follows:
"G.R. No. 244289 (People of the Philippines v. Geralyn Batugon y Tiquez @ "Lyn"). — After a review of the records, this Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its September 11, 2018 Decision 1 as to warrant the exercise of this Court's appellate jurisdiction. TCAScE
As correctly held by the CA, all the elements for the crime of parricide under Article 246 of the Revised Penal Code were proven by the prosecution's evidence warranting the affirmance of the judgment of the courts a quo convicting accused-appellant Geralyn Batugon y Tiquez.
WHEREFORE, the petition is DISMISSED. The September 11, 2018 Decision of the Court of Appeals in CA-G.R. CR-HC No. 09691, finding accused-appellant Geralyn Batugon y Tiquez GUILTY beyond reasonable doubt of Parricide as defined under Article 246 of the Revised Penal Code, is hereby AFFIRMED with MODIFICATION. In line with our jurisprudential ruling in People v. Jugueta, 2 accused-appellant Geralyn Batugon y Tiquez is also ordered to pay the heirs of the victim P50,000.00 as temperate damages, aside from the P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages. The imposition of six percent (6%) interest per annum on all damages awarded from the time of finality of this Resolution until fully paid is sustained.
