PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. RICARDO BALANDRA Y DEL ROSARIO, accused-appellant.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated20 June 2016 which reads as follows:
"G.R. No. 219827 (People of the Philippines v. Ricardo Balandra y Del Rosario)
The records of this case were elevated to this Court on September 9, 2015, pursuant to the Resolution 1 of the Court of Appeals (CA), dated June 2, 2009, which gave due course to the notice of appeal filed by the accused-appellant, Ricardo Balandra y Del Rosario.
The Court then issued its Resolution, 2 dated November 25, 2015, which directed both parties to submit their supplemental briefs, if they so desired. On February 3, 2016, the Office of the Solicitor General, filed a manifestation 3 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised. On February 19, 2016, the accused-appellant filed a manifestation in lieu of supplemental brief 4 averring that he would adopt his Appellant's Brief filed before the CA.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law of the Court of Appeals in its September 16, 2008 Decision in CA-G.R. CR-HC No. 00519-MIN, finding accused-appellant Ricardo Balandra y Del Rosario GUILTY beyond reasonable doubt of Violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment, and to pay a fine of Five Hundred Thousand Pesos (P500,000.00).
