NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 20 March 2019 which reads as follows:
"G.R. No. 240746 (People of the Philippines v. Rosario Baladjay)
After a judicious study of the case, the Court resolves to DISMISS the appeal 1 for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the March 8, 2018 Decision 2 of the CA in CA-G.R. CR-HC No. 08122 and AFFIRMS said Decision finding accused-appellant Rosario Baladjay GUILTY beyond reasonable doubt of the crime of Estafa, defined and penalized under Article 315, paragraph 2 (a) of the Revised Penal Code, in relation to Presidential Decree No. 1689. 3 Accordingly, she is sentenced to suffer the penalty of imprisonment for an indeterminate period of four (4) months of arresto mayor, as minimum, to one (1) year and eight (8) months of prision correccional, as maximum, and to pay the amount of P1,100,000.00 as civil indemnity. Moreover, the monetary award shall earn an interest at the rate of twelve percent (12%) per annum from the filing of the information, or on May 18, 2004, 4 until June 30, 2013, and six percent (6%) per annum from July 1, 2013 until the finality of the Resolution, and the total amount of the foregoing shall, in turn, earn an interest at the rate of 6% per annum from finality of the Resolution until full payment.
SO ORDERED."
