NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated February 24, 2014, which reads as follows:
"G.R. No. 208687 (People of the Philippines vs. Sheila Paclay Bagtang).—The Court resolves to:
(1) NOTE the letter dated December 4, 2013 of Superintendent Rachel D. Ruelo of the Correctional Institution for Women, Mandaluyong City, confirming the confinement therein of accused-appellant since October 17, 2011;
(2) NOTE accused-appellant's Manifestation (in Lieu of Supplemental Brief) dated January 8, 2014 that he is adopting the appellant's brief as his supplemental brief for the same had adequately discussed all the matters pertinent to the appellant's defense and to GRANT the prayer that this manifestation be duly noted in compliance with the Resolution dated October 23, 2013; and
(3) NOTE and GRANT the Office of the Solicitor General's Manifestation and Motion dated December 20, 2013 praying that it be excused from filing the supplemental brief in this case as the appellee's brief dated August 15, 2012 had fully addressed the issues raised by the appellant.
Considering the allegations, issues, and arguments presented, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision issued on December 13, 2012, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law of the Court of Appeals in its Decision dated December 13, 2012 in CA-G.R. CR-H.C. No. 05142 and AFFIRMS the said Decision, finding accused-appellant Shiela Paclay Bagtang guilty beyond reasonable doubt of the crime of violating Sec. V, Par. 1 of Republic Act No. 9165 and sentencing her to suffer the penalty of life imprisonment and pay a fine of one million pesos (PhP1,000,000). (Bersamin, J., designated Acting Member per Special Order No. 1640 dated February 19, 2014 in lieu of Abad, J., who is on leave of absence.)
