Please take notice that the Court, Third Division, issued a Resolution dated December 10, 2018, which reads as follows:
"G.R. No. 238913 (People of the Philippines v. Ramon Demol y Borja, Ernesto Palla y Plaza, Jose Artoza y Katang-Katang, Silverio Superable y Refuerzo, Cesar C. Amado, Fidel Superable y Caaya, Hector Ragaza Cornista y Reotutar, Cerio Macanip, Jr., Ramil Victoriano y Pacayra, Renato N. Superable, Alejandro Aldas y Aure, Dominador Cornista y Ricardo, Mariolito Demol y Racquel, Gerardo Anover y Macanip, Alvin Labra y Cornista, Rodolfo Artoza y Cenecio, accused; Jose Artoza y Katang-Katang and Silverio Superable y Refuerzo, accused-appellants) — The Court NOTES the Office of the Solicitor General's Manifestation and Motion (in Lieu of Supplemental Brief) dated September 4, 2018 praying that it be excused from filing a supplemental brief considering that the Appellee's Brief of March 14, 2014 had already addressed the issues raised by the appellant.
Considering the allegations, issues, and arguments presented in the appellants' supplemental brief and the appellee's brief, which the latter adopted instead of filing its supplementary brief, this Court resolves to DISMISS the appeal for failure of the appellants to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the findings of fact and conclusions of law in the Decision, 1 dated July 31, 2017, of the Court of Appeals in CA-G.R. CR. HC No. 04522, are AFFIRMED. Appellants Jose Artoza y Katang-Katang and Silverio Superable y Refuerzo are found GUILTY beyond reasonable doubt of the crime of kidnapping for ransom with homicide. They are sentenced to suffer the penalty of reclusion perpetua, without eligibility for parole. Appellants are ordered to pay the heirs of Betti Sy y Chua the following awards of damages: P100,000.00 as civil indemnity; P100,000.00 as moral damages; and P100,000.00 as exemplary damages, all with legal interest at the rate of six percent (6%) per annum from the finality of judgment until full payment.
