NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated August 7, 2017, which reads as follows:
"G.R. No. 211163 (People of the Philippines, Plaintiff-Appellee, vs. Eduardo Agote y Cardona alias "Eddie", Accused-Appellant). — After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Decision 1 dated June 27, 2013 of the Court of Appeals (CA) in CA-G.R. CEB CR-HC No. 00900 committed any reversible error in upholding the conviction of accused-appellant Eduardo Agote y Cardona alias "Eddie" of the crime of murder under Article 248 of the Revised Penal Code.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated June 27, 2013 of the Court of Appeals in CA-G.R. CEB CR-HC No. 00900 and AFFIRMS the decision finding accused-appellant Eduardo Agote y Cardona GUILTY beyond reasonable doubt of murder with MODIFICATION, in conformity with prevailing jurisprudence, 2 that the award of moral damages is increased from Php50,000 to Php75,000, the award of temperate damages is increased from Php25,000 to Php50,000 and the award of exemplary damages is increased from Php30,000 to Php75,000. These amounts shall earn interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid. (Jardeleza, J., no part in view of his prior action in the Office of the Solicitor General; Peralta, J., designated additional Member per Raffle dated February 27, 2017.)
