Please take notice that the Court, First Division, issued a Resolution datedJuly 22, 2019which reads as follows:
"G.R. No. 245532 (Vanessa Curilan Pastor v. People of the Philippines) — The petitioner's first and second motions for extension totaling sixty (60) days within which to file a petition for review on certiorari are GRANTED, counted from the expiration of the reglementary period.
After review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its July 12, 2018 Decision 1 and February 21, 2019 Resolution, 2 as to warrant the exercise of the Court's discretionary appellate jurisdiction. HTcADC
The Court, however, modifies the interest imposed on the monetary award pursuant to Nacar v. Gallery Frames. 3 The rate of legal interest for loans or forbearance of any money, goods or credits, and allowed in judgments is twelve percent (12%) per annum computed from default. With the issuance of Bangko Sentral ng Pilipinas Circular No. 799-2013, the 12% per annum rate applies until June 30, 2013. From July 1, 2013, from finality of the decision until its full satisfaction, the interest rate of six percent (6%) per annum applies. When the judgment of the court awarding a sum of money becomes final and executory, the rate of legal interest shall be six percent (6%) per annum from such finality until its satisfaction, the interim period being deemed to be by then an equivalent to a forbearance credit.
WHEREFORE, the July 12, 2018 Decision and February 21, 2019 Resolution of the Court of Appeals in CA-G.R. CR No. 39677 are AFFIRMED with MODIFICATION, that petitioner Vanessa Curilan Pastor is ORDERED to pay the amount of P600,000.00 representing the amount of the unpaid Security Bank Check No. 0889615, with legal interest at the rate of twelve percent (12%) per annum from October 3, 2011 until June 30, 2013; and, thereafter, six percent (6%) per annum until finality of this Resolution. Petitioner shall further pay interest at the rate of six percent (6%) per annum from the date of finality until fully satisfied, and pay the costs of suit. CAIHTE
