Please take notice that the Court, First Division, issued a Resolution datedNovember 22, 2017, which reads as follows: EcTCAD
"G.R. No. 233355 (Romulo de los Santos Pagayon v. Sarah Divina A. Morales). — The Court resolves to DENY the petition and AFFIRM the Court of Appeals (CA) Decision dated May 18, 2017 and Resolution dated July 27, 2017 in CA-G.R. CV No. 103013 for failure to sufficiently show that the CA committed any reversible error in denying the appeal filed under Rule 41 of the Rules of Court.
The CA correctly affirmed the findings of the Regional Trial Court. The title of the property was transferred under the name of respondent Sarah Divina A. Morales after the expiration of the redemption period. She is then entitled to the possession of the property as a matter of right. Also, as correctly ruled by the CA, the issuance of the writ of possession is a ministerial duty of the trial court.
