Please take notice that the Court, First Division, issued a Resolution datedJune 10, 2019which reads as follows:
"G.R. No. 244097 (Pacific Ocean Manning, Inc./V. Ships UK Ltd. v. Leo B. Ingking). — After review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in denying the petition. The CA correctly ruled that, although the petitioner's company-designated physician declared respondent fit to work, it was unable to refute respondent's claim that he can no longer discharge his usual duties on board without discomfort and pain, and his disability has affected his capacity to earn as a seafarer on board any ocean-going vessel. Thus, it is evident that respondent's disability is already deemed permanent and total. HTcADC
WHEREFORE, the Decision dated September 21, 2018 and Resolution dated January 8, 2019 of the Court of Appeals in CA-G.R. SP No. 151959 are hereby AFFIRMED.
