FIRST DIVISION
[A.C. No. 9646. September 4, 2019.]
MICHAELLA ANGELI I. ORTEGA, complainant, vs.ATTY. HERMIE S. ABAN, respondent.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedSeptember 4, 2019which reads as follows:
"A.C. No. 9646 (Michaella Angeli I. Ortega v. Atty. Hermie S. Aban)
In its February 16, 2016 Report and Recommendation, 1 the Office of the Bar Confidant (OBC) found that complainant failed to present substantial evidence to support the administrative charges against respondent. It must be emphasized "that a mere charge or allegation of wrongdoing does not suffice. Accusation is not synonymous with guilt. There must always be sufficient evidence to support the charge." 2 Thus, considering that the findings of fact and the recommendation of the OBC are supported by the evidence on record and by applicable laws, the Court ADOPTS and ACCEPTS these findings and recommendation and resolves to DISMISS the case against Atty. Hermie S. Aban.
The Report and Recommendation dated February 16, 2016 of the Office of the Bar Confidant in compliance with the Resolution dated March 9, 2015 is NOTED.
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
