Please take notice that the Court, First Division, issued a Resolution datedFebruary 7, 2018which reads as follows: EATCcI
"G.R. No. 230111 (Office of the Governor, Province of Quezon and Civil Service Commission v. Dr. Luis S. Mallari III). — The Court resolves to DENY the petition and AFFIRM the Court of Appeals (CA) Decision dated October 11, 2016 and Resolution dated February 10, 2017 in CA-G.R. SP No. 139270 for failure to sufficiently show that the CA committed any reversible error in reversing the Decision and Resolution dated November 24, 2014 and February 3, 2015, respectively, of the Civil Service Commission, and ruling that respondent Dr. Luis S. Mallari III is not guilty of simple neglect of duty.
As correctly held by the CA, respondent exercised due care and diligence in the performance of his duty when he personally examined the patient and determined that there was no need to perform surgery on her. Respondent also exerted efforts to call Dr. Anneavbit De Luna to inform her of the patient's situation and to convince her to admit the patient to the Department of Medicine.
The petitioner's compliance with the Resolution dated June 5, 2017 submitting the certified true copy of the Civil Service Commission Decision No. 140900 and the respondent's manifestation praying for the dismissal or denial of the petition for reasons stated therein are both NOTED. The counsel for petitioner is hereby directed to COMPLY within five (5) days from notice hereof with A.M. No. 07-6-5-SC dated July 10, 2007 re: statement of contact details (e.g., telephone number, fax number, cellular phone number or e-mail address) of parties or their counsels in all papers and pleadings filed with the Supreme Court.
